by agreeing to this Terms of Service Agreement, I acknowledge that I have read, understand, agree to and accept all the terms and conditions contained in this agreement.

I agree that by enrolling in the Transform Coaching Academy Coaching Certification Program (herein referred to as “program”), I agree either:

i) to pay one payment of $5,995 for the program

OR

ii) to pay 10 monthly payments of $647 for the program (payments due every 30 days after the initial payment)

I agree that by enrolling in the Transform Coaching Academy™ Coaching Certification Program (program), I agree to pay in full for this nine module coach training program beginning February 22, 2024. I understand that I am entering into a binding contract with the Transform Coaching Academy™ and Eve Agee International, LLC to enter into a nine module course and I am responsible for full payment of fees for the entire program regardless of whether I actually attend or complete the program, and regardless of whether I select a lump sum or a payment plan.

I understand and agree that I have thirty calendar days from the commencement of the course on February 22, 2024 to request a full refund. I understand if I request a refund for any reason during the first thirty calendar days from the commencement of the course on February 22, 2024, I will receive a refund in full. I agree that in order to receive my refund, I must return the program manual and all course materials in good as new condition with no marks, tears or rips and in original packaging. I understand that if requested in the first thirty days from the commencement of the course on February 22, 2024, I will receive said refund, only after my manual has been returned to Transform Coaching Academy™ staff in good as new condition and I will not receive any bonuses from the program. I understand and agree that after thirty calendar days from the commencement of the course on February 22, 2024, all payments are non-refundable. I understand and agree that if I commit to a payment plan for this program, if I withdraw from this program any time after thirty calendar days from the commencement of the course on February 22, 2024, I will continue to pay in full for this training program and my payments will continue on the normal payment schedule I have agreed to pay, even if I do not commence this program or do not attend the classes. I agree that all sales are final after thirty calendar days from the commencement of the course on February 22, 2024 and I am responsible for full payment of program fees whether I select a lump sum or payment plan, and whether I attend the course or not.  If my payment plan extends past the 6 month program duration, I agree that I will continue to make payments until I am paid in full.

I understand and agree that if I become unable to commence or continue this program and my training in it any time after thirty calendar days from the commencement of the course on February 22, 2024, I can inform Eve Agee International, LLC in writing to request that my payment be transferred to a future training program or other coaching services offered by Eve Agee International, LLC. I understand that it will be at the discretion of Eve Agee International, LLC if this request is granted and all credits granted will expire within 12 months of written approval.

I understand that I will be charged a 10% late fee for all payments that are not received or unable to be processed by the agreed upon installment due date. I understand that if paying by payment plan, I fail to make a complete and full payment, I may become ineligible for this payment plan and may be fully responsible for the balance due immediately.

I agree that if I violate this agreement I will be fully responsible for any collection fees and all legal fees, including any expenses that may be incurred by the Transform Coaching Academy™, Eve Agee International, LLC or Eve Agee, Ph.D. I hereby release and forever discharge the Transform Coaching Academy™, Eve Agee International, LLC and Eve Agee, Ph.D., from any and all claims, actions, demands and suits of any nature. I acknowledge that Eve Agee, Ph.D. and Eve Agee International, LLC shall have the authority to choose the form and location of resolution of any dispute or claim in which they are involved.

I understand that I will receive the full course manual 4-6 weeks after the first class of the program begins depending on printing schedules and mail delivery schedules that are out of control of Eve Agee International LLC and the Transform Coaching Academy™ (and that these times may be longer if I live outside of the continental United States). I understand that if I have not received my manual, I will receive the initial course materials (module 1 and/or module 2 and/or module 3) delivered electronically two days prior to the commencement of that module of the program that commences on February 22, 2024.

I understand and agree that I will receive all program bonuses such as the Magnetizing Clients 7 Part Exclusive Coaching Business Training with Dr. Eve throughout the program, as specified in the program description.

If I pay for the program using the “One Payment Option” I understand that I qualify for the “Full Pay Bonus Package.” I acknowledge and agree that I will receive said bonuses during the segments of the program as specified in the program description and not sooner. In addition, I agree that I will receive a 30 Minute Personal Coaching Business Breakthrough Session with Dr. Eve, and it is my responsibility to contact her to schedule this private one on one coaching session during the program.

I understand that the full duration (nine modules delivered over 6 months beginning February 22, 2024) of the Transform Coaching Academy™ Coaching Certification Program has been approved for 80.25 ICF credit hours by the International Coach Federation (ICF). I understand to gain certain ICF credits through this program I will need to attend live virtual classes and have my attendance tracked by program staff. I understand that for the documentation of my attendance to take place for classes, I must arrive to the class 5 minutes prior to the beginning of class for roll call and verbally signify my attendance when my name is called. I understand that if I do not attend required class segments for which the ICF credits are given, I will need to do make up work to receive these credits. I understand that to gain full Level 1 ICF credit for the program, I must participate in observed practice coaching by the instructor 5 times. I understand that I will receive verbal feedback and a written feedback form on this observed practice coaching. I acknowledge that to receive ICF Core Competency credit for the recorded (asynchronous) learning class segments, I must listen to those recorded classes in full and submit the related journaling assignment for each asynchronous lesson to Transform Coaching Academy™ staff. I acknowledge that to receive ICF credit for participating in the 60 minute Triad Coaching Practice Group sessions, I must attend classes related to that subject live, attend the triad group and practice coach with my classmates and submit the related journaling assignment for each Triad Coaching Practice Group to Transform Coaching Academy™ staff. I acknowledge that if I complete only a portion of this Transform Coaching Academy™ Coaching Certification Program live and participate in the classes verbally and show up for roll call so my presence in specific classes is documented for each segment, then I may be given partial credit for the specific approved ICF credit hours for those approved program segments as per ICF policy. I understand I will have the opportunity to attend make up classes taught by Transform Coaching Academy staff.

I understand that the choice to gain ICF credits through this program is entirely up to me and at my discretion and will be determined by my participation in program segments available for specific ICF credits. I may choose to take the program and not gain any ICF credits. If I do wish to gain ICF credits during this program, I must inform Eve Agee, Ph.D. and Transform Coaching Academy™ Staff of my intention and make myself available for the appropriate live program segments that are available and the roll call for those segments for which I want to receive ICF credits. I understand and acknowledge that not all program segments are approved for ICF credits or the same types of ICF credits and it is my responsibility to keep track of which segments qualify me for ICF credits as well as which qualify me for specific amounts of Core Competencies or Resource Development credits, using the program schedules provided to me during the program.

I understand that if I have notified Transform Coaching Academy™ staff and Eve Agee, Ph.D. that I wish to receive ICF credits during the program then after completion of the program, I will receive a letter documenting completion of the specific number of ICF credits that I earn during the full duration of the Transform Coaching Academy™ Coaching Certification Program starting February 22, 2024 and going through the entire program. I acknowledge that it is my responsibility to retain this letter until it is time to renew my ICF Credential or to use when I apply for an ICF Credential. I understand that if I plan to use these ICF credit hours to apply for an ICF Credential, that there are other requirements that I will need to fulfill to gain credentialing with the ICF. I understand and acknowledge that attendance in the Transform Coaching Academy™ Coaching Certification Program does not guarantee I will gain credentialing with the ICF or any other governing body or organization.

I acknowledge that all rules, regulations, use, and approval of ICF credits are determined by the ICF and I agree not to hold Eve Agee, Ph.D., Eve Agee International LLC or the Transform Coaching Academy™ liable or responsible for any changes now or in the future to International Coach Federation credentialing, ICF credits, CCE, or continuing coach education decisions, policy changes, or membership requirements. I understand and acknowledge that as per ICF policy and terms, ICF has granted approval of Level 1 Accreditation for this specific program on September 8, 2023. I understand that ICF has specific credentialing requirements that are completely determined by and governed by ICF. I understand that if I choose to apply for an ICF credential, I will pay the International Coach Federation directly and these ICF fees and any other credentialing fees are in no way included in my Transform Coaching Academy tuition. I agree that upon completion of the Transform Coaching Academy™ Coaching Certification Program, I will receive a credit letter that I can use toward ICF credentialing or credentialing renewal. I understand that I have the opportunity to gain ICF credits through the Transform Coaching Academy™ Coaching Certification Program and I acknowledge that the other requirements for the ICF credentialing application will not be included in this certification program.

I understand that to become certified as a Transform Coaching Academy™ Coach, I will successfully complete the entire nine module Transform Coaching Academy™ Coaching Certification Program and have my coaching observed and approved by Transform Coaching Academy™ staff five times during the certification program.  I understand that there is no extra expense for this.

I agree to respect the privacy of all program participants. I agree not to violate the privacy or publicity rights of any fellow program participants and will keep confidential all personal and proprietary information that is discussed by other participants during any aspect of the coaching program, virtual classes, practicum coaching sessions, question and answer segments, partner practice coaching sessions, group coaching community sessions, or triad coaching practice meetings with other participants.

I understand that to assure that all program participants have a positive program experience, I agree that I will follow program guidelines and act respectfully to all staff and other participants. I agree that if I become disruptive, difficult to work with, or impair the participation of program participants, disrupt the virtual classes, live events, or disrupt and impede any scope of the work of Transform Coaching Academy™, as deemed by the sole discretion of the staff of Eve Agee International, LLC, this company has the right to terminate this agreement and limit, suspend or terminate my participation in the coach training program without refund or forgiveness of monthly payments.

I understand that Eve Agee, Ph.D. and any other program instructors or special guests do not provide legal, accounting, tax, financial, medical or mental health advice and the information provided to me by the program instructors is not intended as such. I agree to refer all legal, tax, health, medical, accounting, and financially related inquiries to appropriately qualified professionals. I understand that Eve might bring in a guest expert for added value.

I understand that every effort has been made to accurately represent the Transform Coaching Academy™ Coaching Certification Program and that no guarantees have been made as to the potential for future success, financial earnings, or personal fulfillment. I agree that each individual’s success depends on many factors, including his or her background, personal circumstances, dedication, motivation, and desire and I acknowledge, as with any business endeavor, that there is an inherent risk of loss of capital and there is no guarantee of any future financial earnings.

I understand that as a participant in the Transform Coaching Academy™ Coaching Certification Program, I grant permission to Eve Agee International LLC and Dr. Eve Agee the right to use my name and voice and video participation, in whole or in part, from all audio recordings, video recordings, live event recordings and webcast recordings of the Transform Coaching Academy™ Coaching Certification Program, including bonus calls, practice coaching Practicum Classes, individual coaching segments during virtual classes, group coaching community sessions, and question and answer segments of the full nine modules of Transform Coaching Academy™ Coaching Certification Program classes, including any individual coaching by me or of me by Eve or other coaching participants, and questions and answers during the classes. I acknowledge that by check marking the required Terms of Service box on the digital payment area or signing this document, my permission grants Eve Agee International LLC and Dr. Eve Agee the right to package in portions or in whole the Transform Coaching Academy™ Coaching Certification Program including segments that contain my voice or video participation as individual products and also may be transcribed and reproduced in written form to be used individually or combined with other products.

I understand that the teachings, publications, methodologies, and materials imparted to or obtained by me during participation in the Transform Coaching Academy™ Coaching Certification Program are the proprietary intellectual property of the program and Eve Agee, Ph.D. and cannot be distributed, taught, sold, modified, or reproduced by me for any other purpose other than for conducting my individual & group coaching sessions and my coaching programs. I understand that all materials in this program are protected by copyright laws and cannot be distributed, republished, broadcast, made into derivative works for sell or transfer, or reproduced by me for information products, publications, teaching coach training, mastermind groups, coach training programs, Internet sales, certification programs, or any other purpose, other than to use with my individual coaching clients and my group coaching programs.

I have read (or have had read to me) this Terms of Service and agree to be bound by the terms and conditions therein and adhere to the tenets of this contract.
